The government has introduced this legislation to raise standards across the recruitment industry. One of the main aims is to provide greater protection for both job seekers and companies who use the services of recruiters. Among other things, the Regulations require recruitment companies to provide specific information to applicants and also to 'validate' these candidates before introducing them to employers. Although in some ways the Regulations are not appropriate to businesses like Afcon People Solutions, who deal largely with professional contractors, we must nevertheless do our best to comply.

We have to tell you that:  Afcon People Solutions operates both as an Employment Business (temporary and contract positions) and an Employment Agency (permanent positions).

In either instance, the services that we provide will be work-seeking services through which we will try to identify vacancies within our client companies suitable to your particular skillls and experience.

We do not charge you any fee for these work-seeking services.

Please note that, under the Regulations, we are not able to start providing you with work-seeking services until you have provided the required details.

Temporary/contract assignment through a Limited Company (Personal Services Company)
You may have already formed a Limited Company, in which case it is possible for you to opt out of the Regulations. The advantages of this are:

  • Speed - no need for you to pre-agree terms or provide proof of identity, eligibility or skills
  • IR35 - not opting out will reduce the possibility of working outside IR35 legislation
  • Avoid possible additional administration costs for those remaining opted-in

If you choose to opt out, we can continue to work with you in exactly the same way as we always have.

To opt out, we require two disclaimers from you, (i) on behalf of the Company and (ii) from you as the named individual worker.

  • Limited Company opt out
  • Individual worker opt out

We will mail samples of these to you on request.

These may be combined into one document if you prefer as long as all relevant details are included. If you wish to opt out from the Regulations, please let us have your confirmation as quickly as possible.

Your Limited Company must be in existence before you can opt out. You might consider working through an Umbrella Company in the meantime.

You may of course work through a Limited Company without opting out of the Regulations.

Temporary/contract assignment through an Opted-In Limited Company
Before we can begin to provide services to you, we have to obtain your initial agreement to our standard
Terms we will send a sample out on receipt of your mail. Please confirm in writing that these are acceptable in principle to you (subject to any future mutually-agreed variation).

Additionally, before we can proceed with your application, we must also obtain the following from you:

  • Formal confirmation that you are willing to perform a role suitable to your experience and skills.
  • Some proof of your identity - for example a copy of your passport, recent P45, birth certificate or ID card.
  • Evidence of your legal entitlement to accept a job, if offered - for example a copy of an EU passport, valid work permit or visa. This may be the same as proof of identity.
  • If it is a specified requirement of a role for which you may be suitable, we will also need to see proof of technical or educational qualifications.

Please attach the relevant documentation to an email.

If you are uncertain about what to send for any of the above, please contact us. Be assured that once we have logged receipt of these various items you will not need to send them again should you apply for similar roles through Afcon People Solutions in future.

Temporary/contract assignment through an Umbrella Company
If you are planning to work through an Umbrella company, you may use any approved company. If you work via an Umbrella Company, it will be possible for you to opt out of the Regulations. In other words, we can continue to work with you in exactly the same way as we always have.

The advantages of opting out are:

  • Speed - no need for you to pre-agree terms or provide proof of identity, eligibility or skills
  • IR35 - not opting out will reduce the possibility of working outside IR35 legislation
  • Cost - it seems likely that Umbrella companies will pay a slightly lower rate to opted-in contractors because of the additional administrative burden

To opt out we will require opt-out confirmation from both the Umbrella and yourself, the named individual worker. The above named companies have already notified us of their agreement to opt out should the individual worker require it, so if you choose to work through one of them we will only require confirmation from you.

Please let us have this as quickly as possible so that we can begin to process your application.

Working as a directly Payrolled contractor through This means that although you will be a self-employed worker, Afcon People Solutions will help you with administration by deducting PAYE, National Insurance contributions etc. when you are paid.Afcon People Solutions

DATA PROTECTION

This statement outlines how AFCON People Solutions (“AFCON”) stores and uses the information that you provide to us, to ensure that we comply with Directive 95/46/EC on the Protection of Individuals With Regard to the Processing of Personal Data and on the Free Movement of Such Data (the “Data Protection Directive”), with the Data Protection Act 1998 and with any other local implementations of the Data Protection Directive (together the “Data Protection Legislation”).
You can either accept these Terms of use (“Terms”) and continue with the application, or decline these Terms, in which case your application will terminate.
Any personal data provided by you may be stored on servers outside the EEA and, by providing your personal data, you are consenting to such transfer.  Your personal data will be further processed (as necessary) by AFCON entities within the EEA.  Accordingly, all personal data provided by you shall be collected and processed in accordance with the Data Protection Legislation and shall only be used by AFCON for the purpose of processing your application for an employment position within AFCON, or for matching your details with any of the other employment positions within the
Afcon People Solutions Limited
(AFCON) (unless you notify us in writing otherwise).
By providing personal data to AFCON, you are giving your explicit consent to AFCON to process that personal data in accordance with the provisions of the Data Protection Legislation, which may include passing your personal data to other AFCON and AFCON companies outside of the EEA.  We will treat all personal data as private and confidential except where permitted or required by law to make a disclosure, or where the disclosure is made with your consent / in relation to your application. If you are applying for a position in an AFCON entity located outside of the EEA, we may need to transfer your personal data to that AFCON entity.  Accordingly, you hereby explicitly consent to AFCON transferring, where necessary, your personal data to any relevant AFCON entities located outside of the EEA.  If your personal data is transferred to an AFCON entity outside of the EEA, that AFCON entity will, to the extent that there are in force local data protection laws in the country where such entity is located, comply with those local data protection laws in the processing of your personal data.
You agree that the personal data which you provide to AFCON is in all respects true, accurate and up to date and is not, in any respect, misleading, deceptive or inaccurate or likely to mislead or deceive.
Notwithstanding anything contained in these Terms, you agree to inform AFCON in writing in the event that any of the information you have provided is no longer accurate or up to date during the period in which AFCON retains your personal data.
AFCON will retain your personal data for a period of 24 months from the date of your application or any subsequent contact. This is to enable us to match your details to any future suitable vacancies that may arise within AFCON or the AFCON. After this 24 month period, your personal data will be removed from AFCON’ system.  However, you may request the removal of your personal data from AFCON’ system at any time prior to this by emailing
info@afconpeople.com
with Remove My Details in the subject line.
If your application for an employment position with AFCON is successful, we will hold your personal data for the length of your employment with AFCON and for as long thereafter as may be required by AFCON in order to ensure compliance with any applicable statutory or regulatory provisions in any relevant jurisdictions, and with any other obligations imposed on AFCON.
In the event that you are provided with a user id and/or password at any time by AFCON, you are responsible for maintaining the confidentiality of that user id and/or password. You agree to immediately notify AFCON of any unauthorised use of your user id and/or password.
Any breach of the above conditions may result in legal action being taken against the individual concerned. Your Account Information is password-protected for your own privacy and security. Data transmissions are protected by industry-standard SSL-encryption.
AFCON may amend these Terms at any time.  However, if any substantial changes are made to the way in which AFCON processes your personal data, we will notify you by posting a prominent announcement on our website.
